These Terms and Conditions (“Terms and Conditions”, “Terms”, “Agreement”) set forth the general terms and conditions of your use of the annarekers.com website (“Website” or “Service”) and any of its related products and services (collectively, “Services”). This Agreement is legally binding between you (“User”, “you” or “your”) and Anna Rekers Smart SkinCare (“Anna Rekers Smart SkinCare”, “we”, “us” or “our”). 

Agreement to terms 

By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions at all times.

If you do not agree with the terms of this agreement, which includes our Privacy Policy, you must not accept this agreement and may not access and use the Website and Services. 

You acknowledge that this agreement is a contract between you and Anna Rekers Smart SkinCare, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Language  

This contract shall be concluded in English.

Use of Website and Services 

Please note that you must be at least 18 years of age to use the Website and Services.

 By using the Website and Services and by agreeing to this Agreement you warrant and represent that: 

1. You are at least 18 years of age. 
2. You will use this Website, its content and Services for your personal use only.
3. You are legally capable of forming a binding contract with Anna Rekers Smart SkinCare.
4. You are a holder of a valid debit /credit card.

Registration and accuracy of account information

In order to place orders through the Website, you can either set up an account and register with us, or opt to use the guest checkout option on the Website. In either case you agree to provide complete, accurate and current billing and account information for all purchases made at our store.

Please note that if you create an account on the Website, you are solely responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. 

We may, but have no obligation to, monitor and review new accounts before you may sign in and start using the Services. 

As part of the account set-up and registration process, you may be asked to select a username and password.  We may refuse to grant you a username for any reason in our sole discretion, including in the event that we determine that such username impersonates someone else, is illegal, vulgar, or otherwise offensive, or is protected by trademark or other proprietary rights law, or may cause confusion in some other way. 

You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. You agree not to provide false contact information of any kind, disclose your password to anyone or impersonate any other person or entity. 

We reserve the right to refuse service and/or terminate accounts without prior notice if you violate these Terms and Conditions or if we decide, in our sole discretion, that it would be in Anna Rekers Smart SkinCare’s best interest to do so.

You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. 

We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.

General conditions of use

We grant you a limited, non-transferable and non-exclusive licence to access and make personal use of our Website.

Use of this Website does not include the right to 1) download (other than page caching) or modify it in any way or any portion of it 2)make use of the Website or its content in any way other than for personal use.

You may not reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.

You understand that your information (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.  Credit card information is always encrypted during transfer over networks.

Privacy Policy

Please refer to our Privacy Policy for information on how we collect, use, and disclose information from our users. You acknowledge and agree that your use of the services is subject to our Privacy Policy.

Prices

All prices indicated on our Website are indicated in Euros. All prices for products via our Website are inclusive of VAT (where applicable) at the current rates and are exclusive of delivery charges. The total cost of your order is the price of the products ordered and delivery charges. 

You will be charged our recommended retail prices in Euros if purchasing from a European country, in GBP if purchasing in the UK, and in USD for all other locations in the world.

Payment methods

It is possible to pay for your order through the credit, debit and prepaid cards of Visa, MasterCard, and Maestro.

In order to enter your card details, you are transferred to the safe system of the Alpha Bank and after successful payment you will be returned to our online store.

It is also possible to use PayPal to pay for your order, or make a bank account deposit (Alpha Bank or Piraeus Bank Greece). In the latter case please contact us for the bank details.

Imports and Duties

Please note that orders for the delivery outside Greece may be subject to import duties and taxes (including VAT and GST) which are levied when the order reaches the specified destination country. 

These charges will vary from country to country and are NOT included in our shipping prices.  We will not refund your order if you do not want to pay these import or customs charges. Customers placing the order will be responsible for payment of any such import duties and taxes. 

Please note that we have no control over these charges and cannot predict their amount. Please check with your local customs office for further information before placing your order. 

Cancellation Policy

Under the distance selling regulations you have the legal right to cancel your order within seven working days from the date of receipt of the goods if you send us a notice of cancellation in writing and return the goods to us in their original, sealed, unopened and unused condition. Prohibited uses

In addition to other terms as set forth in the Agreement, you are prohibited from using the Website and Services or Content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, national, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Website and Services, third party products and services, or the Internet; (h) to spam, phish, pharm, pretext, spider, crawl, or scrape; (i) for any obscene or immoral purpose; or (j) to interfere with or circumvent the security features of the Website and Services, third party products and services, or the Internet. We reserve the right to terminate your use of the Website and Services for violating any of the prohibited uses.

If you would like to link to this Website you agree to comply with the following guidelines:

1. You may not incorporate or replicate our Website content (e.g., by in-lining, framing or creating other browser or border environments around our Website’s content). 

2. You may only link to this Website with an underlined textual link to the Home Page of our Website. You cannot link to any other page of our Website.

3. You may not imply that we have any affiliation or relationship with your website, products or services, or that we endorse such website, products or services.

4.  Your website does not contain content that could be construed as derogatory, offensive, controversial or obscene.

Similarly, all trademarks, service marks, graphics and logos used in connection with the Website and Services, are trademarks or registered trademarks of Anna Smart SkinCare or its licensors. Other trademarks, service marks, graphics and logos used in connection with the Website and Services may be the trademarks of other third parties. Your use of the Website and Services grants you no right or license to reproduce or otherwise use any of Anna Smart SkinCare or third party trademarks.

Accuracy, Completeness and Timeliness of Information

Although we take all reasonable care to keep the Website as up to date as possible, the information including product descriptions, images and prices appearing on the Website at a particular time may not always reflect the product exactly at the moment you place an order.

To the maximum extent permitted by applicable law, the aggregate liability of Anna Smart SkinCare and its affiliates, officers, employees, agents, suppliers and licensors relating to the services will be limited to the amount you paid Anna Rekers Smart SkinCare for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

Indemnification

You agree to indemnify and hold Anna Smart SkinCare and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website and Services or any willful misconduct on your part.

Severability

All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable.

Dispute resolution

Your use of this Website and any purchase by you of any goods from Anna Rekers Smart SkinCare shall be governed by Greek law and the parties hereto submit to the exclusive jurisdiction of the Greek courts (Athens).

We reserve the right to modify this Agreement or its terms relating to the Website and Services at any time, effective upon posting of an updated version of this Agreement on the Website.
